Maine AG: Kittery Won’t Face Legal Action Over Marijuana Shop Lottery

The town’s 2021 marijuana business lottery did not violate state law, according to the state attorney general’s office.

Kittery held the lottery with the three winners getting the first chance to apply for each of three marijuana shop licenses, one each in three different parts of town.

The attorney general’s office earlier this year informed Kittery the legality of the lottery was under review because the lottery may have been a form of “unlawful gambling.” However, Maine Assistant Attorney General Katie Johnson backed off that language in a letter sent to Kittery’s legal counsel dated March 31.

“Although there is no express legislative authority for a municipality to conduct such a lottery, because of the specific facts of this case, the Office of the Attorney General does not currently intend to pursue legal action in this matter,” Johnson wrote.
